You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use The Same Page. If you’re creating an account for your organization, you represent that you have the authority to bind that organization to these Terms.

Your Account

You are responsible for maintaining the security of your account credentials. Do not share your password. You are responsible for all activity that occurs under your account.

Acceptable Use

You agree to use The Same Page for lawful, legitimate team-management purposes. You agree not to:

• Store or process data about your employees without the right to do so under your own organization’s policies and applicable law
• Attempt to reverse-engineer, scrape, or systematically extract data from the Service
• Use automated scripts or bots to interact with the Service
• Attempt to gain unauthorized access to another organization’s data
• Use the Service in any manner that violates applicable law

AI Features and No Professional Advice

The Same Page uses AI to generate draft content, including performance insights, assessment drafts, and meeting-note extraction.

AI output is not professional advice. Nothing in the Service constitutes HR, legal, or employment advice. AI-generated content may be inaccurate, incomplete, or inappropriate for your specific situation, and it is always presented as a draft for a person to review. You are solely responsible for reviewing AI output before relying on it in any real personnel decision — a review, a rating, a promotion, or any other employment action.

Your Data

You and your organization retain full ownership of the data entered into The Same Page — goals, projects, notes, and assessments included. By using the Service, you grant us a limited license to store and process that data for the sole purpose of providing the Service to you.

We do not claim ownership of your data and will not use it for any purpose beyond operating the Service, as described in our Privacy Policy.

Service Availability

We operate The Same Page on a best-effort basis. We do not guarantee uninterrupted or error-free service. We may perform maintenance, apply updates, or experience downtime without prior notice.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to provide notice of material changes.

Intellectual Property

The Same Page platform, including its interface, branding, and underlying technology, is our intellectual property. Nothing in these Terms transfers any intellectual property rights to you, except the limited right to use the Service as described herein.

Limitation of Liability

To the maximum extent permitted by applicable law, The Same Page and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim (or $10 if you have not paid us anything).

Indemnification

You agree to indemnify and hold harmless The Same Page and its operators from any claims, damages, or expenses (including reasonable attorney’s fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third party’s rights.

Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms.

Upon termination, your right to use the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the “Last Updated” date and, where appropriate, by email. Continued use of the Service after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Maine, without regard to its conflict of law principles.
